Terms & Conditions
This Terms and Conditions (the “Contract”) is a public offer by Murphica (the “Provider”) to any individual or legal entity (the “Client”) who accepts this offer on the terms below.
1. Terms and Definitions
1.1 The following terms are used in this Contract:
1.2 Acceptance - full and unconditional acceptance of this Contract by the Client by creating an account on murphica.com, using the Service, or purchasing Credits.
1.3 Site / Service - the website and services available under the murphica.com domain and related applications or interfaces that provide access to Murphica features.
1.4 Credits - prepaid units used to access certain features of the Service. Credits are not money, have no cash value, and are non-refundable.
1.5 Content - any text, prompts, images, files, inputs, outputs, generated images, or other data submitted to or produced by the Service.
1.6 Generated Image - any image produced by the Service based on Client inputs.
1.7 Model Training - optional functionality where the Service processes Client-provided images to create or personalize a model for that Client (e.g., style/persona training).
1.8 Personal Account - the Client’s account area used to access, manage, and purchase Credits and use features.
1.9 Contact Email Address - the email address used by the Client to register and the email address used by the Provider for communications.
2. Subject of the Contract
2.1 The subject of this Contract is the provision of access to the Service for AI-based image generation and related features (the “Services”).
2.2 The Provider may use third-party technical solutions and service providers (including AI model providers) to deliver the Services.
2.3 The features, pricing, and availability of Services are published on the Site and may change at any time.
2.4 Acceptance occurs when the Client registers on murphica.com, uses the Service, or purchases Credits.
2.5 The Client may use the Service only where permitted by applicable law. If the Service is prohibited where the Client resides or uses it, the Client must not use it.
3. General Terms for Providing the Services
3.1 The Services are provided under this Contract and the rules published on the Site.
3.2 If the Site rules conflict with this Contract, the Site rules will prevail for that specific feature or context.
3.3 The Provider may refuse registration or access to the Service without explanation.
3.4 The Provider may modify, suspend, or discontinue any part of the Service at any time.
3.5 The Service is provided “as is” and “as available.” The Provider does not guarantee uninterrupted availability, specific results, or suitability for any purpose.
4. Eligibility and Content Rules
4.1 The Service is intended for users 13 years of age or older. By using the Service, the Client confirms they meet this requirement.
4.2 Nudity and sexual content are not allowed. The Client must not attempt to generate, upload, request, or distribute nudity, sexual content, or sexually explicit material using the Service.
4.3 The Client must not use the Service to generate or facilitate illegal, hateful, abusive, violent, exploitative, or otherwise harmful content.
4.4 The Client must not create deepfakes of real people, impersonate individuals, or generate content intended to mislead others about a person’s identity.
4.5 The Client must not generate celebrity likeness or content that infringes third-party rights (including copyrights, trademarks, privacy rights, or publicity rights).
4.6 The Provider may use automated and/or manual systems (including third-party tools) to detect violations and block content or accounts.
5. Payment Procedure and Cost of Services
5.1 The Client pays for Services by purchasing Credits in advance using available payment methods shown on the Site.
5.2 All purchases are final. No refunds are provided.
5.3 Credits may expire or be modified only if expressly stated on the Site. Otherwise, the Provider may change Credit pricing or feature cost at any time.
5.4 The Provider may block or terminate accounts involved in payment abuse, fraud, or chargebacks. In such cases, the Client may lose access to unused Credits.
6. Intellectual Property and Licensing
6.1 The Client retains ownership of their uploaded Content (to the extent they have rights to it).
6.2 The Client retains ownership of Generated Images, subject to these Terms and any third-party rights that may apply.
6.3 The Client grants the Provider a worldwide, non-exclusive, royalty-free license to process Client Content solely to provide and operate the Service.
6.4 The Client grants the Provider a worldwide, non-exclusive, royalty-free license to use any Generated Image for marketing, promotional, and showcase purposes, without compensation.
6.5 The Provider does not use Client uploaded images or Client-specific trained models to train or improve the Provider’s general AI systems, except as necessary to provide the requested output and operate the Service.
7. Account Suspension and Termination
7.1 The Provider may suspend, restrict, or terminate any account at any time if the Provider suspects abuse, fraud, violations of these Terms, or risk to the Service or third parties.
7.2 The Provider is not required to provide an appeal process.
7.3 Upon termination, access to the Service, Content, or Credits may be lost.
8. Confidentiality and Personal Data
8.1 The Provider processes personal data as described in the Privacy Policy. By using the Service, the Client agrees to the Privacy Policy.
8.2 The Client understands that uploaded images may include faces. The Provider does not perform biometric identification or verification, but such images may be considered biometric data under certain laws.
9. Dispute Resolution
9.1 Disputes should first be attempted to be resolved by negotiation via email.

10. Limitation of Liability
10.1 To the maximum extent permitted by law, the Provider is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
10.2 The Provider’s total liability for any claims related to the Service will not exceed the amount paid by the Client to the Provider in the last 12 months.
11. Amendments
11.1 The Provider may amend these Terms at any time by publishing an updated version on the Site. Continued use of the Service after publication constitutes acceptance of the updated Terms.
12. Governing Law
12.1 This Contract is governed by the laws of the United Arab Emirates.
13. Miscellaneous
13.1 If any provision is found invalid, the remaining provisions remain in full force.
13.2 These Terms constitute the entire agreement between the Provider and the Client regarding the Service.
